This document describes our Terms and Conditions of
trading below. These may not all apply in every
situation and are subject to change.
Payment
Deposits: A non-refundable deposit of 50% is required to secure a booking. This deposit is necessary for confirming the date and ensuring booking. If client cancels this shoot for any reason, the initial payment will not be returned to client.
Final Payment: The remaining balance is due on or before the day of the photo or video shoot. Payments can be made via Electronic Funds Transfer (EFT) or other methods agreed upon prior to the shoot. Overdue Payments: Interest will be charged on overdue payments at a rate of 2.5% per month.
Cancellation/Rescheduling of Photo Session
If the client has to re-schedule, it must be done at least 7 days prior to the booking date. If the client has booked an outdoors/weather dependant photo session, the photographer will contact and advise to re-schedule due to unsuitable weather, should the booking date be flexible. The session will be moved to the next suitable/available date at no additional cost.
Copyright and Usage
Ownership: The Photographer retains copyright of all images and footage created. Clients must not reproduce or copy images or footage without permission. Additional Usage: Any usage beyond what was agreed upon in terms of this contract is subject to new permissions and may incur extra charges. Permission: A non-commercial permission is granted at no cost as long as credit is given and the Photographer is notified in advance in writing. Commercial use requires explicit permission and may involve fees. Right to Reproduce: The Photographer reserves the right to use images and footage for promotional, marketing, and editorial purposes.
Photographic Integrity and Alterations:
Client will not make or permit any alterations, including, but not limited to, additions, subtractions, or adaptations, with respect of the Image(s), alone or with any other material, without the prior express permission in writing by the Photographer. Any alteration or modification of the Image(s) by the client or a third party even after permission will not constitute a work of joint authorship.
Social Media
The client is allowed to use the material on their website and on their social media accounts, including Facebook, Instagram, Twitter, and blogs. When published online it is required that citation of photographer be made. The client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts photographs online and agrees that they cannot be cropped, altered in colour, or edited in any way.
Editing
Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view. If the client has special requests shall create a “shot list” of all shots that they require.
Completion of Work
Work is complete when the agreed material is delivered. Delivery will include a Wetransfer.com link or access to Terms & Conditions a web gallery. No images or footage may be copied or used without express permission.
Model Release
The client grants permission to the photographer and his assigns, licensees, and sublicensees permission to use the client’s image in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. The photographer may use client’s image on the photographer’s website, or other advertising.
Variation
No variation of the terms of this contract shall be recognised unless agreed in writing.
Applicable Law
This agreement shall be governed by the laws of the Republic of South Africa.
